TIMESHARE TERMINATION
Timeshare Termination is an option for owners who believe they are victims of the following:
- Fraud
- Misrepresentation
- Breach of contract
FRAUD
A contract can be terminated because of fraud if a person knowingly made a material misrepresentation to disadvantage another person who completely relied on the other party to state the facts about the contract. The contract you made can be cancelled on the grounds of fraud.
Fraud requires an outright single lie or a substantial failure to state a material fact about an essential part of the contract. It will invalidate the contract.
MISREPRESENTATION
Misrepresentation is a contract law concept. It means a false statement of fact made by one party to another party that has the effect of inducing that party into the contract. In common law jurisdictions, a misrepresentation is an untrue or misleading statement of fact made during negotiations by one party to another, the statement then inducing that other party to enter into a contract. The misled party may normally rescind the contract, and sometimes may be awarded damages as well.
BREACH OF CONTRACT
Breach of contract is a legal cause of action and a type of civil wrong, in which a binding agreement or bargained-for exchange is not honored by one or more of the parties to the contract by non-performance or interference with the other party's performance. Breach occurs when a party to a contract fails to fulfill its obligation(s), whether partially or wholly, as described in the contract, or communicates an intent to fail the obligation or otherwise appears not to be able to perform its obligation under the contract.
